|
|
| Quote: | The first of three soldiers at Fort Bragg charged after allegedly appearing on a gay porn Web site has accepted a plea bargain with the military. Pfc. Richard Ashley, a members of the elite 82nd Airborne, will appear this week before a military judge to finalize the agreement.
The other two other soldiers, Pfc. Wesley K. Mitten and Pvt. Kagen B. Mullen, are scheduled to stand trial in May. Officials at Fort Bragg have declined to say if plea deals have been offered in those cases.
All three were charged with sodomy, pandering and engaging in sex acts over the Internet for money. In addition, Mullen was charged with adultery. [my emphasis]
Four other soldiers charged with lesser crimes involving their participation in the Web site have already received sentences that included reduction of rank, forfeiture of a half month pay and restriction to base for 45 days. Once their sentences are complete they will be discharged from the military.
The military-themed Web site continues to operate. It does not appear to make any direct reference to the 82nd Airborne or Fort Bragg. The registered owner of the Web site's domain name lists an address in Fayetteville, the city that adjoins Fort Bragg. |
Adultery is a criminal offence? Or more likely just a bullshit military code one, eh? _________________ "The dignity of an animal is measured by his capacity to revolt in the face of oppression." -- Mikhail Bakunin |

Yes, under the Uniform Code of Military Justice.
| Quote: | Whether or not the military will prosecute adultery as an offense under the UCMJ depends upon the exact circumstances. In short, the particular circumstances of the case must be shown to be "prejudicial to good order and discipline," or "of a nature to bring discredit upon the armed forces."
In addition to these "elements of proof," adultery is one of the hardest offenses to prove. The prosecution must prove sexual intercourse, which usually means they must have a confession or photos. The mere fact that two people are living together is not sufficient to prove sexual intercourse.
Interestingly, in the military, a single person can be charged with this offense. If a single person has an affair with a married person, under circumstances which are determined to be prejudicial to good order and discipline, or of a nature to bring discredit upon the armed forces, they can be charged with adultery.

Paratrooper pleads guilty
| Quote: | An Army paratrooper pleaded guilty Thursday to engaging in sex acts on a military-themed gay pornographic Web site after a judge denied a request to dismiss the case.
Pfc. Richard T. Ashley, one of seven members of the 82nd Airborne Division charged with appearing on the site, faces up to a year in prison, forfeiture of two-thirds pay for one year, reduction in rank and a bad conduct discharge.
Ashley appeared calm in court Thursday, appearing with a military lawyer and a civilian lawyer. His family sat behind him in the courtroom as the judge questioned him about his plea. |
Amazing, eh? They're crying out for recruits for their filthy little war, yet they're still willing to turf out trained personnel over who gets their willy wet where... What a bunch of immature children. It's the stockade for gay porn soldier
| Quote: | A member of the elite 82nd Airborne Division who was involved in a gay porn Web site has been sentenced to 75-days in a military prison, a demotion and then will be discharged for bad conduct.
The sentence was handed down after Pfc. Richard T. Ashley pleaded guilty on Thursday to engaging in gay sex acts on the site.
Ashley was one of seven members of the 82nd Airborne Division charged with appearing on the site.
He was sentenced to 90 days in prison - with 15 days credit for time already served - reducing it to 75 days. He could have been handed the maximum - a year behind bars and then discharge.
Once he serves his sentence Ashley will be drummed out of the military under "don't ask, don't tell" the ban on gays serving openly in the military.
[...]
Like Ashley the others are expected to be discharged under DADT. |

Yah.
| Quote: | | He told a judge he received $7,500 for appearing in the pornographic scenes but didn't perform gay sex acts, though the pornography on the Web site was mostly aimed at gays. |
The median expected salary for a typical Private First Class (E3) is reportedly $18,953.
If the Army must insist on pursuing this matter, I would think it would have been better for the Army to have left out the pandering charges. In what way does it serve the interests of the 82nd Airborne to have it widely known that you can earn 40% of a year's pay by jacking off in front of a camera?
Crimminy! I knew there was a sliding scale for such sites--do more, get paid more. I didn't know it started at $7,500. |

If he got paid $7500, this fellow was doing something other than just masturbating before a camera. I'd be shocked if the going rate for that was higher that $250.
Not that I follow such things ( ), but for about $2500 you can hire a gay porn star to come to your place for the weekend and do, well, pretty much whatever you'd like him to do for (and/or to) you.
Sounds to me like this guy may have been the main man convincing his fellow paratroopers to provide 'content' to the website.
ETA; Apparently, Mark Simpson, a sometime writer for Details magazine was present for some of the video shoots for this porno set-up... and ended up in the bed:
Towleroad (blog):
| Quote: | I asked him how he solicited the talent. "Well, mostly these days it's word of mouth. But in the good old days I would go up to them wherever I found them, including Wal-Mart, and say, 'Have you ever thought about modeling? You have a wonderful face,' and hand them my card." Would he target only men who were by themselves? "Nope. Often I go for the best-looking one in a group. He's usualy the leader, and if you get him, then the others come along too. Plus, you're flattering a guy by approaching him in front of his friends and telling him how good-looking he is."
...
As I sat on the sofa watching Jason and Carl perform while I hid behind my notebook, Dink started suggesting, first in jokey fashion, then more seriously, that I join in. "Just for ten minutes or so. It would be great for your story."
I laughed it off— "Oh, I couldn't, I'm English, after all." But soon the guys too started egging me on.
...
And almost before you could say "God save the queen!" I was stripping down to my foreskin. |

Yet Another Guilty Plea & Sentence
| Quote: | BRAGG, N.C. — A soldier pleaded guilty Tuesday to having sex on a military-themed Web site for money and was sentenced to three months in prison.
Pfc. Wesley K. Mitten, 21, pleaded guilty to sodomy, conduct detrimental to the Army and cocaine use. He will be discharged from the service.
...
Mitten is one of seven soldiers from the 82nd Airborne Division accused of appearing on the Web site. Two others, Pvt. Kagen B. Mullen and Pfc. Richard Ashley, have also pleaded guilty and were sentenced to prison.
...
Four other soldiers were punished outside of the military court system. All four were reduced in rank to private, forfeited half a month’s pay for two months, performed extra work and were restricted to Fort Bragg for 45 days. The Army has discharged one paratrooper and has recommended discharges for the other three... |
